TERMS AND CONDITIONS

Dedicated to riders wishing to discover Morocco

1- Contractual conditions

Confirmation of a booking with Butterfly Motorcycle Tours (BMT) certifies the customer’s agreement to the terms and conditions.

2- Booking and Confirmation

All bookings must be confirmed by sending a duly completed booking form.

However, the booking of a tour is only confirmed once BMT has received a deposit, the amount and terms of payment of which are defined at the time of booking.

The balance of the total cost of the tour must be paid no later than 30 days before the start of the tour. Except in the case of special conditions agreed between the customer and BMT at the time of booking.

3- Cancellation policy

In the event of cancellation more than 60 days before the start of the tour, the deposit paid will be refunded to the customer by BMT through a credit note to be used on another tour, valid for one year following the date of issue.

In the event of cancellation less than 60 days before the start of the tour, the deposit will not be refunded and will be considered as a cancellation fee.

No payment made is refundable in cash. To protect yourself against cancellation of your participation in a BMT tour for any reason whatsoever, the customer may take out private travel cancellation insurance.

In the event of cancellation of the tour by BMT, all payments made will be refunded to the customer.

4- Insurance and Liability

Participants to Butterfly Motorcycle Tours are encouraged to take out personal and private medical insurance as well as travel insurance covering tour activities. BMT is not responsible for personal damage, loss or theft of personal belongings.

5- Customer responsibility

Participants to Butterfly Motorcycle Tours are required to comply with local laws, follow safety instructions provided by BMT and abide by the rules of responsible driving throughout the tour.

Participants must also inform BMT of any pre-existing medical conditions. Participation in our tours may be subject to specific medical conditions.

BMT reserves the right to exclude any participant who disrupts the tour or endangers the lives of other participants.

6- Butterfly Motorcycle Tours responsibility

BMT undertakes to provide services of the quality described in the promotional material. In the event of a problem, BMT will endeavor to resolve the situation fairly.

7- Motorcycle rental as part of Guided tours

Rental conditions for hiring motorcycles as part of BMT tour packages are as follows:

– To be at least 25 years old
– To Hold a motorcycle license with over 3 years validity
– Present a valid passport or identity card.
– To have a good motorcycle riding experience
– To Pay a deposit by credit card

Deposit table

BMW R1250GS : 2 500 Euros
BMW F850GS : 2 000 Euros
BMW F750GS : 1 500 Euros

This deposit will be returned to the customer or destroyed in his or her presence after the motorcycle has been checked on return from the tour and if no damage has been caused.

In the event of material damage to the motorbike during the tour, the cost of repairs (parts and labor) will be paid by the customer up to the amount of the corresponding deposit.

The options and accessories of the motorbikes hired may vary from one motorbike to another. If the customer wishes a specific option or a particular accessory, he must make a request to BMT. BMT’s response will be based on availability at the time of booking.

All our motorbikes are equipped with Crash Bars, hand guards, high bubbles, etc.
As part of our guided tours, they are also equipped with an aluminum Top Case.

On our self-Guided tours, motorcycles are also equipped with 2 aluminum side cases.

8- Insurance

All motorbike hire includes third-party liability insurance for personal injury, property damage and financial loss. Maximum coverage for personal injury is subject to the guarantees applicable in Morocco. This coverage is limited to Moroccan territory.
In the event of at-fault accidents, damage caused when parking, theft of the motorbike or hit-and-run by the other party, the customer will be liable for up to the full amount of the deposit.

The customer is responsible for all breaches of the highway code or public order. In such cases, BMT is exempt from all costs and fines.

Premium insurance

As part of BMT’s guided tours, customers can take out premium insurance, which allows them to halve their deposit. The cost of this additional insurance is 20 euros per day.

The deposit amounts per model are then as follows:

– BMW R1250GS : 1,250 Euros
– BMW F850GS : 1,000 Euros
– BMW F750GS : 750 Euros

Premium insurance is not possible for self-guided tours.

9- Assistance

– Guided tours

All our guided tours include the assistance of a Tour Guide on a leading motorcycle and a mechanic driving a support vehicle. The team is on hand to help customers organize the tour (logistics, check-in and check-out, restaurants, etc.), as well as carrying out regular maintenance on the motorbikes and repairing any breakdowns.

– Self Guided tours

BMT’s assistance is available for the entire duration of the tour.
In the event of a motorbike breakdown for which the customer is not responsible, BMT undertakes to replace the motorbike in question within 12 hours of the customer’s request at no extra cost.

In the event of a breakdown for which the customer is responsible (driving error, riding on an unauthorized route, etc.) or of an accident occurring during the tour and requiring mechanical assistance from BMT or the replacement of the motorbike, all costs incurred for this assistance will be invoiced to the customer (transport costs, handling, accommodation and catering for the assistance team, ….). These costs will be added to the cost of repairing the motorcycle, including spare parts, up to the limit of the deposit paid at the outset.

10- Force Majeure

BMT reserves the right to modify or cancel the tour or any stage of the tour without financial liability in the event of force majeure (unforeseeable events, natural disasters, road conditions, weather conditions, etc.). Customers will be informed of any major changes.

11- Disputes and jurisdiction

Any disputes will be submitted to a jurisdiction determined by Moroccan law. Every effort will be made to resolve any dispute amicably.

12- Complaints

Customers may submit any complaints to BMT within a maximum of 15 days after the end of the tour. BMT undertakes to investigate complaints and to deal with them fairly.

13-Terms and conditions modifications

BMT can modify these terms and conditions at any time. Customers will be informed of any changes before booking.
